By accessing or using this website www.pipspiro.com and purchasing original paintings and limited edition prints from Pip Spiro (the "Artist"), you agree to comply with and be bound by these Terms and Conditions. Please read them carefully. If you do not agree to these terms, you must refrain from using the Site.

2. Intellectual Property

All content on the Site, including but not limited to text, images, paintings, prints and other artistic works, are the exclusive property of the Artist and are protected by copyright laws. You may not copy, reproduce, distribute, or use any of the content for commercial purposes without express permission from the Artist.

3. Artwork Information

All artworks on the Site are created by the Artist. Every effort is made to represent the artwork accurately; however, due to differences in monitor settings, colors may vary slightly from the actual paintings.

4. Ordering and Payment

By placing an order through the Site, you are offering to purchase an original painting or art piece. Once your payment is processed, you will receive an email confirmation of your order. All payments must be made in full prior to the shipment of any artwork. The Artist accepts payments through [list accepted payment methods, e.g., credit cards, PayPal, etc.].

5. Shipping and Delivery

Shipping costs are not included in the purchase price unless stated and are calculated at checkout. We use a third party specialised art courier service to ensure the safe passage of artworks. In the case that the shipping price in not included at checkout, the Artist will provide an independent shipping quote for customer approval and will then ship your purchase to the address provided at checkout. The Artist ships within Australia and most destinations internationally. Delivery times may vary depending on the destination, and the Artist is not responsible for any delays caused by third-party couriers.

The Artist will take all reasonable care to ensure that artwork is securely packaged to avoid damage during shipping and insurance for shipping is provided by the third-party courier. However, the Artist cannot be held responsible for any damage or loss during transit.

6. Returns and Refunds

Due to the nature of the products being original artwork, all sales are final. However, if you receive a damaged or defective painting, please contact the Artist within [number of days, typically 7-14 days] of receipt. The Artist will offer a replacement or refund for damaged items, provided that the damage is reported promptly with photographic evidence.

7. Custom Orders

If you wish to commission a custom painting, the Artist will work with you to create a unique piece based on your specifications. Custom commissions require a deposit to begin the work, and full payment is required upon completion before shipping. Custom orders are non-refundable once the painting is completed, unless the artwork is damaged during delivery.

8. Limitation of Liability

To the fullest extent permitted by law, the Artist is not liable for any damages arising out of or related to the use of the Site or the purchase of artwork. This includes, but is not limited to, any direct, indirect, incidental, special, or consequential damages, even if the Artist has been advised of the possibility of such damages.
